Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Tradxstks website and application (the “Service”) operated by Shivanshu Chouhan. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service is operated by Shivanshu Chouhan, an individual operating the Tradxstks platform as a sole proprietor. References to “we”, “us”, or “our” mean Shivanshu Chouhan.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract under the laws of India to use the Service.

2. Accounts & Authentication

  • Sign-in is passwordless: you authenticate with a one-time code sent to your email.
  • You are responsible for maintaining access to your email account and for activity under your account.
  • Notify us immediately of any unauthorised use.

3. The Service

Tradxstks lets you book paid consultations, communicate with an advisor, share documents for review, and join video consultations. Availability of features may change over time.

4. Payments, Cancellations & Refunds

  • Consultation fees are shown before you confirm a booking and are processed by our payment provider (Razorpay).
  • You authorise us to charge the applicable fee for the service you book.
  • Cancellations and refunds are governed by our cancellation window as communicated in the app. Refunds, where applicable, are made to the original payment method.

5. No Investment Guarantee

The Service does not guarantee any investment outcome. All content is subject to our Risk Disclaimer, which forms part of these Terms. Investments are subject to market risk.

6. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes or to upload unlawful, infringing, or harmful content.
  • Attempt to gain unauthorised access to the Service, other accounts, or our systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse engineer or misuse any part of the Service.

7. User Content

You retain ownership of documents and messages you submit. You grant us a limited licence to host and process that content solely to provide the Service. You are responsible for ensuring you have the right to share any content you upload.

8. Intellectual Property

The Service, including its software, design, and trademarks, is owned by Shivanshu Chouhan and protected by law. These Terms do not grant you any right to our intellectual property except the limited right to use the Service.

9. Third-Party Services

The Service relies on third parties (payments, email, video, hosting). We are not liable for their acts or omissions, and your use of them may be subject to their terms.

10. No Advisory or Fiduciary Relationship

Use of the Service, including booking or attending a consultation, does not by itself create any investment-advisory, fiduciary, brokerage, or professional relationship between you and Shivanshu Chouhan. Any information or discussion is general and informational unless a separate, signed advisory agreement expressly states otherwise. You are solely responsible for your own financial and investment decisions. See our Risk Disclaimer.

11. Disclaimers & Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Shivanshu Chouhan shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or any investment or trading losses, arising from or related to your use of the Service or any consultation, whether based in contract, tort, or any other theory, even if advised of the possibility of such damages.

To the maximum extent permitted by law, the total aggregate liability of Shivanshu Chouhan to you for all claims arising out of or relating to the Service shall not exceed the total fees you actually paid for the specific consultation giving rise to the claim in the three (3) months preceding the event. Some jurisdictions do not allow certain exclusions; in such cases liability is limited to the smallest amount permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Shivanshu Chouhan, and his successors and assigns, from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) any investment, trading, or financial decision you make; (c) your breach of these Terms or applicable law; or (d) any content you submit.

13. Termination

We may suspend or terminate your access if you breach these Terms or to comply with law. You may stop using the Service at any time.

14. Governing Law & Disputes

These Terms are governed by the laws of India. Subject to applicable law, the courts at [City], India shall have exclusive jurisdiction over any disputes.

15. Changes to These Terms

We may modify these Terms. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
